4 Your rights

4.1 In this Section 4, we have summarised the rights that you have under applicable data protection laws. 4.5 Right to rectification: You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed. You can ask us to make any necessary changes to ensure that your personal data is accurate and kept up to date. 4.6 Right to erasure: In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: the personal data is no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; the processing is for direct marketing purposes; and the personal data has been unlawfully processed. However, there are certain general exclusions of the right to erasure. Those general exclusions include where processing is necessary for: exercising the right of freedom of expression and information; compliance with a legal obligation; for the establishment, exercise or defence of legal claims.

The consequences of erasing your personal data are that DC Byte will remove any personal information from our systems, you will cease receiving any market updates or general correspondence from us (other than relating to the deletion of your personal information) and that you will no longer be able to make use or access any of the account-dependent features of the DC Byte platform.

4.7 Right to restrict processing: In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful, but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. 6 Changes to the DC Byte Privacy Statement

6.1 We may update the DC Byte Privacy Statement from time to time by publishing a new version on our DC Byte Platform. If we make changes to this Privacy Statement, we will post the revised Privacy Statement on the DC Byte Platform and update the “Effective Date” date at the top of this Privacy Statement.

6.2 If you disagree with the revised Privacy Statement, you may cancel your account. If you do not cancel your account once the revised Privacy Statement becomes effective, your continued access and/or use of the DC Byte Platform will constitute acceptance of the revised Privacy Statement.

7 How we collect your personal data

We collect your personal data from various sources. These are as follows:

Personal data you provide us about you

7.1 We collect your personal data that you provide us when you do the following:

(a) fill in a webform on our DC Byte Platform e.g. to contact us;

(b) when you sign up for an account with DC Byte;

(c) provide personal data in the account area of our DC Byte Platform;

(d) get in touch with us by email, telephone, letter, and/or some other means;

(e) subscribe to receive communications from us about our products and services e.g. by a newsletter etc.; and

(f) participate in a survey, market research etc.

8.3 Data in your account: We may process your account data (“account data”). The account data may include your name, and email address. The account data may be processed for the purposes of operating our DC Byte Platform, providing our services, ensuring the security of our DC Byte Platform and services, maintaining back-ups of our databases, and communicating with you. The legal basis for this processing is that this is for performance of contract (in providing you with the services offered on the DC Byte platform.

8.4 Data in your profile: We may process your information included in your personal profile on our DC Byte Platform (“profile data”). The profile data may include your name, address, telephone number, email address, and some of your usage data. The profile data may be processed for the purposes of profiling you in order to (a) enhance, improve and personalise your use of our DC Byte Platform and communications, and (b) sent you information that it may be of interest to you (e.g. personalized offers). 8.5 Data we get through the DC Byte Platform: We may process your personal data that is provided in the course of the use of our DC Byte Platform (“service data”). The service data may include usage data. The service data may be processed for the purposes of operating our DC Byte Platform, ensuring the security of our DC Byte Platform, maintaining back-ups of our databases and communicating with you. The legal basis for this processing is the legitimate interests of our business..

8.6 Data we use to communicate with you: We may process information that you provide to us for the purpose of subscribing to our communications (including, for example, direct marketing communications) with you and/or newsletters (“notification data”). 8.8 Data we publish on the DC Byte Platform: We may process information that you provide us for publication on our DC Byte Platform, when you create a listing (“publication data”). The publication data may include your name. The publication data may be processed for the purposes of enabling such publication and administering our DC Byte Platform and business. The legal basis for this processing is the legitimate interests of our business.

8.9 Data we use to bring or defend legal claims: We may process any of your personal data identified in the other provisions of this Privacy Statement where necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

8.10 Data we use to comply with the law: In addition to the specific purposes for which we may process your personal data set out in this Section 8, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another individual.

9 Providing your personal data to others

9.3 Sale/Investment: If there is (a) a sale or an asset transfer to a third party of, and/or (b) an investment in DC Byte, part of that sale, asset transfer and/or investment may include your personal data. Purchasers, investors and/or their advisers may have access to your personal data as part of the corporate due diligence they perform as part of the (a) sale or asset transfer, and/or (b) the investment. However, use of your personal data will remain subject to this Privacy Statement.

9.4 Insolvency: Your personal data may be passed on to a successor in interest as part of a corporate re-organisation or in the unlikely event of an insolvency event such as a liquidation, insolvency, bankruptcy or administration. In the case of an insolvency event, our customer database may be sold separately from the rest of the business, in whole or in a number of parts. It could be that the purchaser’s business is different from ours too.

12 Security of personal data

12.1 We maintain administrative, technical and physical safeguards designed to protect your personal data provided to us. While no system or process is full-proof (e.g. hacking), we believe the measures implemented reduce our vulnerability to security problems to a level appropriate to the type of personal data involved. 13 Retaining and deleting personal data

13.1 This Section 13 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

13.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

13.3 We will retain and delete your personal data as follows:

(a) Any personal information you submit will be retained for 6 months following the date that you leave the platform, at the end of which period it will be deleted from our systems.

13.4 Notwithstanding the other provisions of this Section 13, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another individual.
